UCC CLASS ACTION RESOLUTION PROPOSAL
December 3, 2003 – Toronto – Terms for resolution of a process for determination of class action claims against Upper Canada College (UCC) have been agreed upon by parties to the action. The Ontario Superior Court of Justice is scheduled to consider approval of the proposed resolution on December 30, 2003.
The proposed class action arises from allegations of sexual abuse of students by former UCC teacher, Douglas Brown, in the period of 1975 – 1993.
“A significant aspect of the proposed resolution is access by victims to a private and confidential process for claiming compensation from the school”, said Zoran Samac of McPhadden, Samac, Merner, Barry, the Toronto law firm representing the proposed class.
If approved by the Court, the proposed resolution will involve publication and mailing of a notice to former UCC students of Douglas Brown, inviting them to register their claims.
The proposed resolution was reached without any admission of liability by any of the parties.
“We are pleased that the victims will be provided with an organized, systematic, and confidential mechanism for the fair adjudication of their claims for compensation and those of their family members”, added Samac.
