NOTICE OF SETTLEMENT OF SELWYN HOUSE CLASS ACTIONS CONCERNING SEXUAL ABUSE - Click here to view the Notice of Settlement

The Quebec Superior Court has approved a settlement agreement with Selwyn House School.

The settlement is in respect of three Petitions brought against the school relating to former teachers Leigh Seville, James Hill and John Aimers.

The Settlement Agreement provides for compensation to former Selwyn students whom were sexually assaulted by one or more of the three teachers.

Student victims and immediate family members will be able to seek compensation pursuant to the terms of the agreement. Claimants will be required to complete a Confidentiality Agreement (Schedule G) and a Student Claim Form (Schedule H) in order to obtain information about the compensation available and forms by which to submit compensation claims.

To make a Claim under the Settlement Agreement, Student Class Members shall complete and submit the Student Claim Form set out in Schedule H of the Settlement Agreement by providing all the information requested and duly completing the affidavit required to submit this form. Family Class Members shall complete and submit the Family Claim Form set out in Schedule I by providing all the information requested and duly completing the affidavit required to submit this form. The deadline to submit a Claim Form is the Opt Out Deadline which is 60 days following the present Notice: April 8, 2009. CAUTION! CLAIMANTS SHOULD ACT PROMPTLY, AS DEADLINES MAY INVALIDATE A CLAIM.

Claims must be submitted by April 8, 2009, after which claims will be permanently barred.

We strongly recommend that those interested in participating in the settlement review, complete and submit Schedule G immediately and begin compiling documentation and information needed to complete Schedule H.

Background

McPhadden Samac Merner Barry commenced three class action proceedings in Ontario and Quebec against Selwyn House School. Each class action proceeding relates to an individual teacher. The three teachers in question are Leigh Seville, John Aimers and James P. Hill.

Prior to commencing the proceedings, court orders were obtained restraining the media and the parties from disclosing the identities of the plaintiffs and any other claimants. The Orders were sought so as to prevent the student representative plaintiff from further victimization and to encourage claimants to come forward to assert their claims, knowing that their identities will be kept confidential.

Selwyn House School – MISE A JOUR

Cette Entente concerne les trois requêtes présentées contre l’école au sujet des anciens enseignants Leigh Seville, James Hill et John Aimers. Cliquez ici pour lire l’Entente et les Appendices.

L’Entente prévoit l’indemnisation des anciens élèves de Selwyn qui ont été agressés sexuellement par un ou plus des trois enseignants.

Les élèves victimes et les membres de leur famille immédiate pourront demander à être indemnisés selon les termes de l’Entente. Les demandeurs doivent remplir un Accord de Confidentialité (Schedule G – en anglais) et une Demande Etudiante (Schedule H – en anglais) afin d’obtenir l’information relative au montant de l’indemnisation et les formulaires de demande d’indemnisation.

ATTENTION! LES DEMANDEURS DOIVENT AGIR RAPIDEMENT ET DANS LES LIMITES DE TEMPS PREVUES PAR L’ENTENTE AU RISQUE DE PERDRE LEUR DROIT A ETRE INDEMNISES.

Les Demandes doivent être soumises dans un délai de soixante (60) jours suivant la publication de l’Avis d’Entente dans des journaux désignés ; après ce délai, les demandes seront prescrites.

Nous recommandons fortement que tous ceux désirant être indemnisés aux termes de l’Entente, de remplir et soumettre le Schedule G et de commencer à regrouper leur documents et l’information requis pour Schedule H (demande d’indemnisation) sans délai.

RAPPEL

Notre cabinet a initié trois recours collectifs contre Selwyn House School. Chaque recours concerne un enseignant différent. Les trois enseignants sont Leigh Seville, John Aimers et James P. Hill.

Avant le commencement des trois actions en justice, des ordonnances ont été rendues pour interdire aux médias et aux parties de révéler les identités respectives des demandeurs. Les ordonnances ont pour but d’éviter toute nouvelle victimisation et pour encourager les demandeurs à se faire connaitre, en sachant que leur identité sera protégée.
